Judge Refuses To Drop Charges Against Jimmy Snuka
Murder charges against WWE Hall of Famer Jimmy "Superfly" Snuka will not be dropped, a judge ruled on Tuesday.
Snuka was charged last September with third-degree murder and involuntary manslaughter in the 1983 death of his girlfriend at the time, Nancy Agostino, more than 30 years after the fact.
Judge Kelly Banach, who earlier this summer ruled that Snuka was not mentally competent to stand trial, denied the request and said she would revisit the case later this year. Both District Attorney Charles Gallagher, who is prosecuting the case, and Snuka's defense team have requested the charges be dropped.
Currently, the charges against Snuka are on hold pending determination of his mental status.
Gallagher, specifically, wants to see the charges dropped or have Snuka sent into involuntary outpatient treatment. Gallagher has stated multiple times in court that he thinks Snuka is faking his mental issues in order to avoid prosecution. Both the prosecution and defense have produced expert witnesses to testify on the behalf of each side.
Banuch has denied previous motions by the prosecution to have Snuka sent to a mental hospital and outpatient facility for 60 days to further evaluate his mental state.
Snuka is also part of the latest class action lawsuit against WWE by former wrestlers that claims negligence by the company in treating concussions and brain injuries.
Banuch has issued a gag order that prevents Snuka, his family, the family of Argentino or any of the attorneys involved in the case from discussing it in the media.
