Alberto Del Rio’s trial will have to wait.
Del Rio’s trial, where is facing one count of aggravated kidnapping and four counts of sexual assault after being indicted back in October 2020, was scheduled for May 3, but has been pushed back to Monday, August 2 according to PWInsider.
Del Rio said in a recent interview that the charges had been dropped, but that’s not the case as his trial date is still set.
Del Rio, Jose A. Rodriguez Chucuan, was arrested on May 9, 2020, when police responded to a report from May 4, 2020, he had become angry with a woman and assaulted her causing multiple injuries.
In the original report, the victim said Del Rio slapped her across the head twice before taking her downstairs and forcing her to put on a dress and dance for him and if she cried, he threatened to take her son and drop him in the middle of the road. He also allegedly became angry when she wouldn’t admit to being unfaithful. According to the Bexar County Sheriff’s Office, following his arrest on May 9, 2020, Del Rio was held for about five hours before being released later that afternoon.
Police said Del Rio tied the woman’s hands with boxing straps, put a sock in her mouth, and sexually assaulted her for several hours, using various objects. According to investigators, he also punched her in the back during the assault, causing visible injuries. The victim told detectives she does not remember much after he placed his hand around her throat.
If he is convicted in the first degree, it could result in a sentence ranging from five to 99 years or life in prison and/or a fine up to $10,000.
Del Rio is scheduled to face Andrade on July 31.
